TERMS & CONDITIONS FOR USE OF THE AMPLIFYING CHILDREN’S VOICES DIGITALLY (ACVD) APPLICATION

DEAR USER, PLEASE CAREFULLY READ THE FOLLOWING TERMS & CONDITIONS BEFORE USING “AMPLIFYING CHILDREN’S VOICES DIGITALLY” (ACVD), AN APPLICATION PROVIDED BY World Vision International, developed and hosted by iSMART360.

These Terms and Conditions govern the use of the application belonging to World Vision International (“WVI”) called “Amplifying Children’s Voices Digitally” (hereinafter, “ACVD” or the “Application”), which is hosted on the website with the domain (https://amplifyingourvoices.ismart360.com/) operated and managed by ISMART TRESCIENTOS SESENTA, LTDA. (hereinafter, “iSmart360”), a company headquartered in San Jose, Costa Rica. Herein “you” and “your” refer to you, the “User”.

By accessing and using the pages and/or links of this website, you understand and accept that: (i) you and your parent/guardian/caretaker have read, understood, and agreed to all the terms and conditions set forth herein; and (ii) the parent/guardian/caretaker authorizing your use of the platform has full legal capacity to give such acceptance on your behalf, and to use this website in accordance with the terms described herein. If you do not agree with these terms and conditions, you should not use this website.

If you are a minor, under the majority age of 18, please ask your parent or legal guardian to explain these terms and conditions to you, especially as your parent or legal guardian/caretaker is responsible for the acceptance of these terms and conditions on your behalf.

These Terms will be updated from time to time, and World Vision International will use reasonable efforts to generally notify you of any material changes to these Terms, however, you should look at the Terms regularly to check for such changes. We will also update the “Last Updated” date at the top of these Terms, which reflect the effective date of such Terms. Your continued access or use of the Services after the date of the new Terms constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop accessing or using the Website and/or Application.

RESTRICTIONS ON USE AND INTELLECTUAL PROPERTY RIGHTS

The Application, including its graphic design and all content therein—such as, but not limited to, the “World Vision” trademark and logo, texts, graphics, videos, sounds, audio files, slogans, trademarks, procedures, logos, games, images, and photographs (collectively, the “Intangible Assets”)—are the sole and exclusive property of World Vision International and are protected under applicable intellectual property laws.

You may not copy, modify, distribute, license, publish, upload, republish, transmit, transfer, assign, or sell in any form the materials from this website or Application without World Vision International’s written consent.

EXCEPTION

Downloading materials is only permitted for educational, personal, and non-commercial purposes, if you do not delete or alter any copyright notices, trademarks, or other proprietary notices of World Vision International.

The material contained on this Application and this website is for lawful use only. Any files and images contained in or generated by this Application and/or this website, as well as accompanying data (collectively, the “Software”), is temporarily licensed to you by World Vision International. No intellectual property rights or ownership are transferred to you; they remain the sole and exclusive property of World Vision International. You may not resell, decompile, reverse engineer, disassemble, or otherwise convert the Application into any other form without prior written consent.

LIMITATION OF LIABILITY

World Vision International shall not be liable for any damages or injuries caused—without limitation—by performance failures, errors, omissions, interruptions, defects, delays in operation or transmission, computer viruses, or malfunctions resulting from the use of the Application or the Website. World Vision International shall not be liable for any damages or injuries, including but not limited to, direct or indirect damages arising from the use or the inability to use the materials on the Website, including the specific content related to the ACVD Project.

World Vision International’s total liability to the User is limited to proven direct damages caused by the use of the Application, to the extent permitted by applicable law. This limitation shall not apply in cases of willful misconduct or gross negligence.

Likewise, World Vision International is not responsible for opinions, comments, or any statements made by third parties or Users when using the interactive features of its digital platform, such as chat functions or open spaces for posting comments or uploading images. Users of the Application and/or Website agree to use respectful and courteous language and to refrain from making statements or uploading images or content that is disrespectful, vulgar, or offensive. Any offensive, violent, or inappropriate content may be removed without prior notice.

SUBMISSIONS

All comments, suggestions, ideas, graphics, and/or other information submitted through the ACVD site (collectively, the “Submissions”) may be used by World Vision International and its partners to improve the platform, without this implying any financial compensation or recognition of authorship, unless otherwise provided by applicable law in the user’s country.

Please do not publish any personal information (i.e, any personal data or personally identifiable information) on this Application and/or Website. Any personal information or any other sensitive data that may be received on the website is voluntarily provided by the User.

Such information will not be sold or transferred to third parties by iSmart360 or to entities that are not part of the website’s operation.

DISCLAIMERS

The materials on the Application are provided “as is” and without warranties of any kind, either express or implied, to the fullest extent permitted by applicable law.

World Vision International does not warrant that the functions contained in the materials will be uninterrupted or error-free, that defects will be corrected, or that the Website or the server that makes it available are free of viruses or other harmful components.

This Website may occasionally contain links to other websites that are not maintained or controlled by World Vision International. Therefore, World Vision International shall not be held responsible for the content, security, and/or quality of such sites. The inclusion of these links does not imply World Vision International’s automatic approval of their content, quality, and/or security, and you assume full responsibility for the use of such links and websites. The use of these resources is the sole responsibility of the user.

You are responsible for configuring your information technology, computer programmes and platform to access our Services. You should use your own virus protection software.

TERMINATION

World Vision International may terminate your use of the Application and/or Website at any time without prior notice, at its sole discretion, if you fail to comply with the provisions or terms of these terms and conditions. Upon termination of this agreement, you must destroy all Materials in your possession.

MISCELLANEOUS

These Terms and any claims, causes of action, of any kind or character, or demand arising out of or relating to the Terms will be governed by the laws of the State of California. Any claim, cause of action or dispute, arising out of or relating to these Terms shall also be resolved exclusively in the U.S. District Court for the Central District of California. You also agree to submit to the personal jurisdiction of these courts for the purpose of litigating any such claim. These Terms constitute the whole legal agreement between You and World Vision International and govern your use of the Application and Website and completely replace any prior agreements between you and World Vision International in relation to the Application and Website.

If any part of these terms and conditions is found to be unlawful, void, or unenforceable, that part shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

This document constitutes the entire agreement between you and World Vision International regarding the use of the Application and Website.

USER REGISTRATION ON THE PLATFORM

The closed and customized Website and Application for the Amplifying Children’s Voices Digitally (ACVD) project is intended exclusively for young people between the ages of 13 and 17, who access the platform only through an invitation process managed by authorized ACVD facilitators.

Registration Process:

User registration is conducted in a controlled and private manner, through an invitation email. This email contains instructions for creating a user profile, as well as a secure link to access the digital environment.

Each user must complete an online form, which will request the following information:

Username
Email address
Country of residence
Unique password

Access to the Application is personal and non-transferable. Sharing login credentials with other individuals is not permitted. World Vision International does not access or store the passwords created by users.

Authorization and supervision

Since the Website and Application is intended for minors, it is assumed that the registration and use of the account are carried out with the knowledge and authorization of a responsible adult, such as a parent or guardian .

Data Protection:

World Vision International handles your personal information in accordance with its Privacy Policy and processes, as well as applicable privacy and data protection laws in the U.S.A., where the level of data protection may be different from that in your country. The data you provide will be used solely for educational, participatory, and monitoring purposes within the Application and Website and will not be sold, shared, or transferred to third parties not involved in its implementation.

Account Deletion:

The User, their legal guardian, or the Project team may request the permanent deletion of the account at any time by sending a written request to the support email provided by iSmart360: info@ismart360.com. In such cases, the associated personal information will be deleted in accordance with World Vision International’s and iSmart360’s respective data retention and deletion policies.

RESTRICTIONS

Users agree to use the Platform respectfully and exclusively for the educational, training, and participatory purposes established by the Amplifying Children’s Voices Digitally (ACVD) Project. Accordingly, it is strictly prohibited to:

Use the Application and Website for unlawful, fraudulent, commercial, or unauthorized purposes.
Share offensive, discriminatory, violent, sexual content, or any material that violates the rights of others, especially children and adolescents.
Alter, damage, disable, overload, or otherwise impair the technical operation or security of the site.
Access, modify, or attempt to access without authorization any accounts, systems, or networks connected to the Application and Website.
Use false identities or inaccurate information to register or interact within the virtual environment.

Failure to comply with these restrictions may result in the immediate suspension or deletion of the User’s account, without prejudice to any legal liabilities that may arise.

Account Activity Suspension and Warnings

World Vision International reserves the right to suspend or permanently remove, at any time, any accounts deemed inappropriate or harmful. Prior warnings may also be issued, at World Vision’s discretion.

An account may be suspended for actions or behaviors including, but not limited to:

Violations of applicable law, self-destructive behavior, violence and threats, hate speech and harassment, unauthorized sharing of private information or access to the Application or Website, identity impersonation, spamming, use of the platform for fraudulent activity and other malicious conduct, nudity, pornography and other sexual content, violent expressions or incitement to violence, graphic content, obscene behavior, and infringement of intellectual property rights.

Forced Username Reset

World Vision International reserves the right to require a change of usernames that are found to violate these Terms and Conditions.

Should this occur, the account corresponding to the violating username will be locked and will not be able to be accessed until the account owner completes the username reset process. Once completed, the account owner will regain access to their account.

INDEMNIFICATION

You agree to defend, indemnify and hold harmless World Vision International, iSmart360, and its respective parents, subsidiaries, affiliates and each of their respective officers, directors, employees, agents and advisors from any and all claims, liabilities, costs, expenses, damages or losses (including legal fees and attorney costs) arising out of a breach by you or any user of your account of these Terms or arising out of a breach of your obligations, representation and warranties under these Terms.
